Helmet-wielding windshield smasher may go to prison

ALBANY – A motorcyclist traveling with several other bikers, ATV riders and dirt bikers through Albany last year was found guilty of smashing in a woman's windshield, Albany County prosecutors said.

Shane Hornberger, 31, of Rensselaer was found guilty of felony third-degree criminal mischief after a jury trial in state Supreme County in Albany County, District Attorney David Soares' office said.  

An indictment alleges that on an early May afternoon in 2021 near Clinton Avenue and Quail Street, Hornberger took off his helmet while in traffic and used it to repeatedly strike the car's windshield, causing over $250 in damage, prosecutors said. 

An investigation showed that at the time of the incident, Hornberger was riding a motorcycle with a group of about 50 riders. Members of that group were also riding all-terrain vehicles and dirt bikes, which can’t legally be used on roads. 

Hornberger will be sentenced on Oct. 28 and he faces 1 1/3 to 4 years in state prison, officials said. 

Assistant district attorneys Joseph Brucato and Taylor Cupp are handling Hornberger's prosecution.
